Veterans, Asbestos Exposure and Mesothelioma Benefits

Asbestos was historically used in some military ships, shipyards, buildings, equipment and products. Exposure circumstances depend on service branch, era, occupation, duty station and tasks. A veteran with mesothelioma may consider VA disability benefits and, in some situations, claims involving product manufacturers or other entities.

Military settings where exposure may have occurred

Possible contexts include:

  • Ship construction, repair, overhaul and engine or boiler spaces
  • Insulation, pipe, gasket and valve work
  • Building construction, demolition and maintenance
  • Vehicle brake and clutch service
  • Power generation and industrial facilities
  • Damage to older structures containing asbestos

This list does not prove exposure. Records and credible factual evidence are important.

VA eligibility framework

VA states that a veteran seeking service-connected compensation based on asbestos generally needs evidence of:

  • Qualifying veteran status
  • Asbestos exposure during military service
  • A current disease or disability related to asbestos
  • A relationship between the in-service exposure and the disease or disability

Exposure by itself is not a compensable condition. VA may request an examination and medical opinion.

Evidence that may help

  • DD Form 214
  • Personnel and assignment records
  • Military occupational specialty or rating
  • Ship, unit and duty-station history
  • Performance evaluations or work descriptions
  • Medical and pathology records
  • Statements from service members or other witnesses
  • Records of exposure before or after service

Complete history matters because asbestos exposure may have occurred in several settings.

Filing a VA claim

Veterans can apply through VA and may seek help from a VA-accredited representative, claims agent or attorney. Verify accreditation through VA's official tools. No private website can approve a benefit.

VA benefits and civil claims

A VA claim is distinct from a civil lawsuit against a product manufacturer or other non-government entity. Potential interaction, evidence sharing, offsets and deadlines require individualized advice. Do not assume that pursuing one automatically prevents or guarantees another.

Survivors and dependents

Certain survivors may qualify for VA benefits depending on service connection, cause of death and other requirements. Eligibility is program-specific.
